Acceptance of Terms
By using the BlackLith website, requesting a quote, placing an order, paying a deposit, making a final payment, or accepting delivery, you agree to these Terms and all policies linked from the website.
If written order documents, invoices, production confirmations, or signed agreements conflict with these website Terms, the more specific written order document may control for that order.
Orders, Deposits, and Production
BlackLith sells prefab, modular, expandable, and custom housing products. Orders may require a manufacturing deposit before production begins. Unless otherwise stated in writing, the deposit confirms the buyer's intent to reserve production, materials, planning, and administrative work.
- Product images, renderings, videos, dimensions, and descriptions are provided for reference and may vary slightly due to manufacturing, material availability, product improvements, custom selections, and shipping preparation.
- BlackLith may request additional confirmation before production begins, especially for custom selections, drawings, finish choices, shipping details, and special requirements.
- Production timing depends on order queue, selected model, customisation complexity, material availability, quality control, and payment status.
Customisation and Buyer Approval
Custom homes are built according to selected options and agreed specifications. Custom choices may include flooring, layout, bathroom package, wall panels, bathtub, kitchen layout, cabinets, countertops, finishes, and other approved options.
After production begins, changes may be unavailable or may require additional cost, additional time, or separate written approval. If a buyer requests a change after production has started, BlackLith may accept or decline the change depending on feasibility.
Customer Responsibilities
The buyer is responsible for confirming that the selected home, dimensions, installation site, permits, foundation, utilities, zoning, import requirements, unloading access, and local building code requirements are suitable for the buyer's location.
- BlackLith may provide product drawings, media, specifications, or support documents when available, but local approval remains the buyer's responsibility unless a separate written service agreement says otherwise.
- The buyer must provide accurate contact, shipping, delivery, and site-access information.
- The buyer must inspect delivered goods promptly and provide photo/video evidence for any claimed delivery damage or manufacturing defect.
Final Payment and Shipping Release
For orders using a deposit structure, the remaining balance must be paid before shipping release, delivery release, or other final order milestones unless BlackLith agrees otherwise in writing.
Production media, photos, videos, or inspection updates may be provided before final payment when available. Final payment confirms that the buyer is ready to proceed with shipping release under the order terms.
Limitations and Fair Use
BlackLith is not responsible for delays or losses caused by customs, port congestion, ocean freight disruption, strikes, weather, governmental action, incorrect buyer information, site-access issues, permit denial, local code changes, buyer-side unloading problems, or events outside BlackLith's reasonable control.
To the fullest extent allowed by law, BlackLith's responsibility for an order is limited to the amount paid for the affected product or the repair/replacement remedies described in the applicable warranty policy. Nothing in these Terms limits rights that cannot legally be limited.
